The appellant Smt. Sathi Devi is a consumer under the Electrical Section, Kollappaly, with consumer number 1157407004829 and residing at Aimcombu. The appellant received a heavy bill for the billing month August/2022 amounting Rs. 13,532/-. The appellant complained to the officials of the Licensee. The meter reader has not taken the reading for the two billing cycles mentioning the meter was not accessible as the gate was closed. The meter reader has not used the wicket gate at the side for entering inside to take reading. The billing was done based on the average consumption of previous billing cycle and the actual reading was taken on the billing month of August 2022. The total amount was calculated by spreading the consumption for the door lock period and adjusted with the provisional bill. The appellant requirement is to revise the exorbitant bill and issue a normal bill on the basis of average consumption. The appellant filed petition to the CGRF and CGRF issued order stating that the appellant is liable to pay the amount as per the bill. Aggrieved by the decision of CGRF, the appellant filed this appeal petition to the authority. On verifying the documents submitted and hearing both the petitioner and respondent and also from the analysis as mentioned above, the following decision are hereby taken. 1. The appellant is liable to pay the charges as per the bill raised. 2. The licensee shall grant 12 instalments for remitting the payment. 3. No interest or surcharge payable. 4. The licensee shall examine whether the meter reader has performed his duty well, if not suitable action is to be taken. 5. No order on cost.

The appellant is a consumer of the licensee under the section Kecheri. He is the owner of a land in kuttamkulam, Melur village, Kunnamkulam Taluk. The officials of kecheri section of licensee has erected stay wires of the posts in his property without the consent. Initially one straight stay wire and V type stay wire erected and then the licensee had removed one stay from the V type stay and now two straight stay wires are there. The stay wires inside his property are creating obstruction for the development of the land. The appellant filed petition to CGRF and CGRF issued order dated 31/03/2023 stating that if the appellant suggests an alternate feasible route the respondent can shift on remittance of cost. Aggrieved by the order of the CGRF, appellant filed the appeal petition to this Authority. On verifying the documents submitted and hearing both the petitioner and respondent and also from the analysis as mentioned above, the following decision are hereby taken. 1. The licensee has to remove one stay from the property by providing a tension releasing mechanism to the cable that is an additional post to support the ABC after the gate of the neighbouring property. 2. The shifting of the stay and installation of the post is to be done at the cost of licensee. 3. No order on cost.

Ed. പരിശീലന കേന്ദ്രം കാസർഗോഡ് സ്ഥാപിച്ചത്. കണ്ണൂർ സർവകലാശാലയുടെ കാസർഗോഡ് ക്യാമ്പസ്‌ (Consumer No. 1166886020570) KSEBL ലൈസൻസിയുടെ ഒരു ഉപഭോക്താവാണ്. Govt./Aided സ്ഥാപനങ്ങൾക്കു ബാധകമായ താരിഫ് പ്രകാരം KSEB കാസർഗോഡ് ക്യാമ്പസ്സിൽ നിന്ന് വൈദ്യുത ചാർജ് ഈടാക്കി വന്നിരുന്നു. സ്വാശ്രയ വിദ്യാഭ്യാസ സ്ഥാപനങ്ങൾക്കായി കേരള സ്റ്റേറ്റ് ഇലക്ട്രിസിറ്റി റെഗുലേറ്ററി കമ്മീഷൻ തീരുമാനിച്ച താരിഫ് അംഗീകരിച്ചുകൊണ്ട് ബഹുമാനപ്പെട്ട സുപ്രീം കോടതിയുടെ ഉത്തരവ് പ്രകാരം, ലൈസൻസി ഈ centre-ന്റെ താരിഫ് 6F ആക്കി മാറ്റുകയും ഒരു കാലയളവിലേക്ക് ഒരു ഹ്രസ്വ മൂല്യനിർണ്ണയ ബിൽ നൽകുകയും ചെയ്തു. 7/2009 മുതൽ 7/2015 വരെ രൂപ. 5,87,486/-. സർവകലാശാലയുടെ അപേക്ഷയൊന്നും അംഗീകരിക്കപ്പെട്ടില്ല, തുടർന്ന് അപ്പീൽക്കാരൻ CGRF-നെ സമീപിച്ചു. CGRF 10/03/2022 തീയതിയിൽ ഒരു ഉത്തരവ് പുറപ്പെടുവിച്ചു, ലൈസൻസിയുടെ ഡിമാൻഡ് നോട്ടീസ് അനുസരിച്ചുള്ള ചാർജുകൾ അടയ്‌ക്കാൻ അപ്പീൽ പരാതിക്കാരൻ ബാധ്യസ്ഥനാണെന്ന് പ്രസ്താവിച്ചു. തർക്കം അവിടെയും പരിഹരിക്കപ്പെടാത്തതിനാലാണ് Ombudsman-ന് പരാതി സമർപ്പിച്ചത്. സമർപ്പിച്ച രേഖകൾ പരിശോധിച്ച്, പരാതിക്കാരന്റെയും എതിർകക്ഷിയുടെയും വാദം കേൾക്കുകയും, മുകളിൽ സൂചിപ്പിച്ച വിശകലനത്തിൽ നിന്ന് ഇനിപ്പറയുന്ന തീരുമാനം എടുക്കുകയും ചെയ്യുന്നു. 1. എതിർകക്ഷി പരാതിക്കാരന് നൽകിയിട്ടുള്ള ഷോർട്ട് അസ്സെസ്മെന്റ് ബില്ല് റദ്ദാക്കിയിരിക്കുന്നു. 2. കണ്ണൂർ സർവ്വകലാശാലയുടെ കീഴിലുള്ള കാസർഗോഡ് കേന്ദ്രം എയ്ഡഡ് സ്ഥാപനങ്ങളുടെ ഗണത്തിൽ പെടുത്താവുന്നതിനാൽ 6A താരിഫാണ് ബാധകം. 3. മറ്റു ചിലവുകൾ ഒന്നും അനുവദിക്കുന്നില്ല
