അപ്പീൽ  പരാതിക്കാരനായ  ശ്രീ. സഹദേവൻ, വൈകുണ്ഠം, കണ്ണങ്കോട് ലൈസൻസി (KSEBL)യുടെ വെഞ്ഞാറമൂട് സെക്ഷനിലെ ഗാർഹിക ഉപഭോക്താവാണ്. 10/05/2023 രാവിലെ 11 മണി മുതൽ വൈകുന്നേരം 5 മണി വരെ വെഞ്ഞാറമൂട് കണ്ണങ്കോട് ഭാഗത്ത് വൈദ്യുതി തടസ്സം നേരിട്ടു. അന്നേ ദിവസം 13:42-ന് സെക്ഷൻ ഓഫീസിൽ വിളിച്ചു പറഞ്ഞിട്ടും വൈദ്യുതി ലഭ്യമാക്കിയില്ല. 1912-ൽ വിളിച്ച് പരാതി പറഞ്ഞിട്ടും പരാതിക്ക് പരിഹാരം ഉണ്ടായില്ല. ഇലക്ട്രിക്  ലൈനുകളിൽ പണി നടത്തുന്നതിനു വേണ്ടി വൈദ്യുതി ഓഫാക്കുന്നതാണെങ്കിൽ 24 മണിക്കൂറിന് മുൻപ് ഉപഭോക്താവിനെ അറിയിക്കണം എന്ന വ്യവസ്ഥയും പാലിക്കപ്പെട്ടിട്ടില്ല. വെഞ്ഞാറമൂട് സെക്ഷൻ ഓഫീസിന്റെ കീഴിലുള്ള പല ഭാഗത്തും 12 മുതൽ 16 മണിക്കൂർ വരെ പവർ കട്ടാകുന്നു. അരമണിക്കൂറിൽ രണ്ടു മുതൽ 10 മിനിറ്റ് വരെ പവർ കട്ടാകുന്നു. ഇതു നിമിത്തം വീട്ടിലെ ഇലക്ട്രോണിക് ഉപകരണങ്ങൾ കേടാകുന്നു. ഉയർന്ന ഉദ്യോഗസ്ഥരെ ഫോണിലൂടെ ബന്ധപ്പെടാൻ ശ്രമിച്ചാലും അവരാരും തന്നെ ഫോൺ എടുക്കാറില്ല. ഉത്തരവാദത്തപ്പെട്ട ഉദ്യോഗസ്ഥർക്കെതിരെ നടപടി സ്വീകരിക്കേണ്ടതും, നേരിട്ട നഷ്ടങ്ങൾക്ക് നഷ്ടപരിഹാരം ലഭ്യമാക്കേണ്ടതുമാണ്.

The Believers Church Hospital, Thiruvalla is an EHT consumer of the Licensee (KSEBL). The EHT agreement was executed by the appellant with the licensee on 27/11/2014 and the tariff applicable was EHT General which was the prevailing tariff as per the tariff order dated 14/08/2014 of KSERC. The KSERC by tariff order dated 17/04/2017, the EHT tariff has been categorized into EHT General A & B. The tariff applicable for the Self Financing Institution was EHT General B. The licensee billed the appellant wrongly on EHT General A and the anomaly was detected only on 06/22. In the latest tariff order dated 25/06/2022, the self financing institution were categorized into EHT General C. The licensee had raised bill for the undercharged period for an amount of Rs.9,90,74,445/-. The appellant filed the case to Hon’ble High Court of Kerala challenging the demand raised by the licensee. Hon’ble High Court of Kerala issued order permitting the appellant to remit 2 Crores in two equal or six weekly instalments and the balance amount in 36 equal monthly instalments. The licensee has charged interest for the payment which was not paid within the due date. The appellant has filed a case to the Hon’ble High Court of Kerala and Hon’ble High Court Of Kerala directed the appellant to approach CGRF. Accordingly, the petition has been filed to the CGRF and CGRF issued order stating that the appellant is liable to pay the interest. Aggrieved by the order of CGRF, the appeal petition is filed to this authority.

The appellant Thiruvananthapuram Development Authority (TRIDA) owns a shopping complex named as Kedaram complex at Kesavadasapuram Junction, Thiruvananthapuram. One of the shop was rented out to Smt. Sharma Satheesan and KSEB has given the service connection with consumer number: 11455166017549 with the consent of TRIDA. Consumer defaulted the payment of current charges and the power supply was disconnected on 07/21 and the dismantling was effected on 14/04/2022. The TRIDA has given letter to the licensee on 22/09/2021 to disconnect the power supply as the occupier has vacated the premises. The appellant have been re-issued the shops to another person but the licensee was not ready to give new connection as the outstanding payment was not cleared. The appellant TRIDA was forced to pay the arrears to the licensee. The main allegation was that the power supply was not dismantled as per the request of the appellant and fixed charges were charged up to 14/04/2022 and the entire charges paid by TRIDA is to be refunded. The appellant filed the petition to CGRF and CGRF issued order dated 23/06/2023 stating that the bills are to be revised by charging fixed charges for 180 days from the date of disconnection. Aggrieved by the decision of the CGRF, this appeal petition is filed to this authority.
