The appellant installed an ‘On-Grid Solar Plant’ and connected to the Grid of KSEB Ltd. on 09-03-2018. The appellant received an electricity bill for Rs.84,028/- on 13-11-2020, which was brought to the notice of officials of Licensee and further filed petition before CGRF, Northern Region with a request to exempt from remitting the bill amount. The Forum limited the period of assessment of the bill for 12 months from 20 months. The appellant filed this appeal petition before this Authority. This Authority decided to accept the observations made by the CGRF, Northern Region and hence, upheld the decision taken by the Forum in OP No. 93/2020-21. The appellant is exempted from remitting interest or surcharge for the disputed amount or the revised amount as per the order of CGRF in the petition pending period before CGRF, Northern Region and the appeal petition pending period before this Authority.

The appellants filed a complaint before the Assistant Engineer, Electrical Section Karunagappally North with a request to disconnect the above service connection on the ground that the appellants are enjoying the possession of the landed property where the electric connection was provided. Since no action was taken by the respondent, the appellant filed a petition before the CGRF, Southern Region. The Forum registered the petition and issued order without interfering in the subject matter, but directed the respondent to issue a letter to the registered owner of the service connection, Smt. Rasheedabeevi to produce any valid proof of ownership or legal occupancy of the premises to which service connection has been effected. The appellant filed the appeal petition before this Authority. Though the Licensee is not a respondent in the writ petition W.P. No. 4708/2020 (K) filed by the appellants before the Hon’ble High Court of Kerala, the order of Hon’ble Court says “the disputes between the petitioner and the party respondents are of a civil nature. There is serious dispute regarding the immovable property”. For the reasons detailed above, the appeal petition No. P-025/2021 filed by the appellant stands dismissed as it is found not maintainable before this Authority. The order dated 23-02-2021 in OP No. 88/2020 of CGRF, Southern Region is upheld.

The appellant is running a hotel in the name and style “Hotel KPM International” under the section area of Electrical Section, Sultanpet. The appellant has been paying electricity charge comprising of demand charge for 75% of Contract Demand or maximum demand recorded, whichever is higher in each month and the monthly energy charge. The appellant received an arrear bill in December 2020 for Rs.8,22,974/-. The appellant approached the CGRF, Northern Region with a petition requesting (1) Rebate as per Board Order may be allowed in the fixed charge (Demand Charge) for the months of April, May and June 2020. (2) Demand Charge may be reduced to 75% in all months where billing demand did not exceed 75% of Contract Demand (3) 24 interest free installments may be allowed to remit the arrears up to December 2020. The Forum issued order on 20-02-2021 as follows: - “(a) The relief sought in petition vide (1) and (2) are found devoid of any merits to consider and hence, dismissed (b) The relief noted in item (3) shall be allowed as a special case. The respondent shall collect the arrear amount in 15 equal installments and the installment shall carry interest as per Regulation 131 (2) of Kerala Electricity Supply Code 2014. The appellant need not pay interest for the bill amount for the petition pending period before the Forum.” The appellant filed this appeal petition before this Authority. In the hearing, the respondent confirmed that a review petition in OP No.114/2020-21 filed by the respondent is pending before CGRF, Northern Region and hence the appeal petition P-023/2021 filed by the appellant before this Authority is dismissed. If the appellant is not satisfied with the order of CGRF, Northern Region in the Review Petition, the appellant can file another appeal petition with additional information, if any, within 30 days from the date of order of CGRF, Northern Region in Review Petition.
