The officials of the Licensee inspected the premises on 20-10-2020 and found there was no printing works in the premises. As such the tariff was changed to LT VIF and a short-assessment bill amounting to Rs.2,46,648/- for a period of two years was issued to the appellant. The appellant filed a petition in CGRF and the Forum in its order issued the following: - The respondent is directed to revise the short assessment bill amounting to Rs.2,46,648/- by limiting the period of assessment to twelve months and to allow suitable instalments for the payment of revised amount, if the petitioner desires so. The appellant filed this appeal petition before this Authority. It was decided to quash the short assessment bill for Rs.2,46,648/- issued to the appellant. The respondent is directed to reassign the tariff of the premises of the appellant under LT IV(B) category from 03-08-2020, the date on which the respondent sent notice to the appellant after the routine inspection. The respondent shall revise the short assessment bill under LT IV(B) tariff from 03-08-2020 and issue to the appellant within 30 days from the date of order. The excess amount remitted, if any, shall be adjusted in the future bills or arrears, if any, shall be realized from the appellant. The Appeal Petition filed by the appellant allowed to this extent and the order of CGRF, Southern Region in OP No: 03/2021 dated 19-05-2021 is set aside.

The appellant received an electricity bill for Rs.28,117/- dated 14-10-2020 in the month of 10/2010, stating that the energy meter in the premises recorded 3919 units for a period of 4 months. The appellant filed a petition in CGRF, Southern Region and the Forum in its order rejected the request of the appellant for the cancellation of the bill and directed KSEB Ltd. to allow suitable instalments. The appellant filed this appeal petition before this Authority. The electricity bill issued by the respondent for Rs.28,117/- dated 14-10-2020 is quashed. The respondent is directed to issue a revised bill for Rs.14,059/- (50% of Rs.28,117/-) within 15 days from the date of this order and the appellant shall remit the amount within the due date fixed by the respondent. If the appellant wants to remit the bill amount in installments, the respondent can allow the installments as per rules. The Appeal Petition filed by the appellant is allowed to this extent and ordered accordingly. The order of CGRF, Southern Region in OP No. 07/2021 dated 14-05-2021 is set aside.

The appellant was given two meters for the above consumer numbers for Rs.88,375/- and Rs.35,736/- towards the undercharged amount for the period from 12/2007, following the judgment of Hon’ble Supreme Court. The appellant approached the officers of the Licensee and finally approached CGRF, Southern Region with a petition, requesting to allow the appellant to pay the principal amount only with the facility of instalments. The Forum registered the petition and the Forum vide order dismissed the Petition. The appellant filed this appeal petition before this Authority. The argument of the appellant that, the appellant has never been informed about any short assessment bill since 2007 is not sustainable. In a period of certain petitions and appeal petitions filed by similar institutions were being considered by the Hon’ble Courts, the Licensee cannot issue such bills on the same subject to the appellant. Only on 05-01-2020, KSEB Ltd. decided to issue bills under higher tariff rate to the Self-Financing Educational Institutions except those who availed favourable orders from Hon’ble High Court of Kerala. On the above circumstances, the appellant is liable to remit the amount. In the hearing, the respondent revealed that the benefit of “one time settlement” can be given to the appellant. The appeal petition No: P-041/2021 filed by the appellant stands dismissed. The order dated 30-04-2021 in OP No. 02/2021 of CGRF, Southern Region is upheld.
