the appellant till commissioning of new CT on 12-02-2016. It is revealed from the data downloaded from the meter, by the TMR, Angamaly, there was one phase voltage (B phase) missing from 24-09-2015 to 12-02-2016 and recommended to review the bills for the above periods. Accordingly, the party was served with a provisional short assessment bill on 17-11-2016, when the meter was found recording less than the actual, so as to recover the unrecorded portion of energy, for Rs. 6,21,788/-. The order of CGRF in petition No. 108/2016-17 dated 04-02-2017 is modified to this extent.

Sri. Sathyaseelan, the appellant, having electric connections bearing consumer numbers No. 5737, 5738 and 5739 under Electrical Section Venjaramoodu, Thiruvananthapuram, has filed an Appeal Petition on 22-06-2017 before this Forum and stands numbered as P/068/2017. The appeal is against the order dated 29-03-2017 of CGRF, Kottarakkara, in the Petition No. OP. 258/2016, filed before it. The appellant has also filed a Writ Petition, WP (C) 16331/2017, before the Hon: High Court of Kerala on 15-05-2017, against the CGRF Order, which is under its consideration before the Court. The provisions made under Clause 22(d) of KSERC (CGRF and Electricity Ombudsman) Regulations, 2005, restricts the maintainability of the Petition before this Forum, when a similar nature Petition filed for the same cause of action and its related grievances, is pending before any other Court, Tribunal,Arbitrator or Authority.

The appellant is a consumer having three numbers of LT service connections with consumer numbers 30656, 30517 and 593 availed for the use of Medical Trust Hospital, Nedumkandam under Electrical Section, Nedumkandam. LT service connection with consumer No. 30656 is used for pumping of sewage and waste water and inpatient laundry purpose and consumer number 30517 is used exclusively for pumping water to the above hospital. On 11-04-2017, the APTS team inspected the premises and detected that there was incorrect application of the tariff in both the electric connections and the billing of LT service connection is under LT IV instead of LT VI F. Based on the above finding, provisional assessment bills dated 22-05-2017 for Rs. 99,789/- and Rs. 79,440/- were issued to the appellant. Considering the above facts and legal provisions pertaining to the issue this Authority is of the considered view that the appellant’s premises is not eligible for LT IV tariff. As this a case of incorrect application of tariff, the amount of electricity short collected shall be realized from the appellant by limiting a maximum period of 24 months, without interest
