The meter of the consumer has recorded less reading, as the wires from two phases of Power Supply given to the meter interchanged, by mistake from the part of KSEB, while installing a new CT meter. The consumer disputed the readings obtained or the error noticed in various tests of the meter and hence questions the validity of error percentage reported after the Test done on the meter. It is directed to revise the bill as per the average consumption of the consumer prior to the meter change. The consumer is bound to pay the energy charges for the actual energy he has consumed and the licensee can recover the amount so undercharged.

The APTS team during its inspection had detected that the multiplication factor (MF) of the meter taken for the reading was wrongly noted as 20, when the actual MF to be applied was 40. The consumer questions the MF detected as 40 and the raising of the bill for the undercharged amount of a dismantled temporary connection. Also raised the limitation bar under Sec. 56(2) of Electricity Act, 2003. It is established that the consumer was billed only half of his true energy consumption during the disputed period and the consumer is bound to pay the electricity charges for the actual energy he has consumed.

The consumer approached CGRF praying for tariff revision of his building, used for accommodating senior citizens, from LT VII A commercial to LT VI D or LT I A- domestic, as he is running an old age home in his building. The CGRF gives direction to KSEB to revise the tariff to LT I A (domestic), if the consumer produces a residential certificate from the Panchayath. The Board has filed a writ petition before Hon.High Court which was disposed with direction to file an appeal before this Forum. It is revealed that the consumer has not registered his institution with the Govt. as an old age home or no inmates are residing at present there. The present owner of the building is a registered charitable society and hence it is decided to assign tariff applicable to convents, LT VI A till the consumer produce the Govt approval.
