A KSEB squad inspected the premises of the consumer and found that the premise was being used for commercial activities instead of domestic tariff alone and the connected load has increased substantially. The consumer was served a provisional bill for unauthorized use of electricity under sec 126 of IE Act 2003. The cause for the dispute is whether CGRF has power to adjudicate such cases and whether the AE himself has to make an inspection to assess a consumer under Section 126 of IE Act, 2003 among other things.

The consumer purchased an industrial plot having arrears of the previous consumer whose service was dismantled and RR action has been initiated. As per the new Regulation under Supply Code, the new entrant has to pay the electricity charges alone without interest, till the arrears is recovered from the original defaulter.
Unauthorized additional load and tampering of meter - abnormalities detected by the APTS, KSEB in respect of two consumer numbers of the consumer – P/258/2012 and P/259/2012 – Mohammed Siddique, Palarivattom.

The consumer was issued two numbers of short assessment bills by the KSEB for the abnormalities detected in respect of two consumer Nos and the consumer has cleared the bills fully, after the Hon. High Court Order. Now the dispute is over the short assessment bills issued in continuation of the original bill consequent to an audit report. It is held that once the liability is fully paid up by the consumer, the respondent cannot extend the liability, on the same irregularity, as he is absolved from any further liabilities on that account, as per section 126(4), prevailing at that time.
