The energy consumption in one phase is not recording in the meter and also detected unauthorized additional load in the premises of the consumer. To recover the revenue loss, the consumer was issued short assessment bill assessing the energy escaped from billing as 1/3rd and to recover penal charges for unauthorized use of energy for 1 KW by KSEB. In the case of short assessment bill during meter faulty period, it is directed to revise the bill based on the average consumption during the previous period. In the case of the penal bill for the UAL , the Forum not considered the merits of the issue since section 126 of Electricity Act will not fall under the purview of the Forum. |

The KSEB has changed the tariff of the consumer, from LT IV to LT VI B and issued a short assessment bill being the difference between the tariff rates. Later, based on the order of CGRF, the KSEB reassigned the consumer’s tariff under LT VII A commercial and issued short assessment bill. The consumer is seen engaged in multiple activities like running an industrial unit, a computer institute, conducting various other training courses etc. The consumer is allowed to segregate the different institutions and apply for eligible tariff for each purposes. |

The consumer has defaulted payment of bi-monthly bill one electric connection (out of 5 nos.) given to her shops. The consumer disputes that she has remitted the charges of the electric connection she is using for her ration shop. The KSEB says that the said Con. No is given to her Telephone booth which has defaulted payment. The consumer alleges that the consumer Nos. of the two shops were mutually interchanged while replacing the faulty meter of one connection by KSEB. Held that the KSEB have indulged in abuse of power in disconnecting the electric connection of the consumer, violating the rules in force and also allowed the litigation cost to the appellant. |
