The appellant shri. Bharath K Patel is the Managing Director of K.P. Cars Pvt. Ltd., which operates an Audi Car showroom situated at Kundannoor, Ernakulam. The appellant had applied for a LT connection to the licensee and had paid Rs. 3,04,653/- on 03/04/2010 as the work deposit. Then the licensee informed that as the connected load is more, HT supply is to be availed and asked them to deposit Rs. 3,96,854/-. Then the total deposit made is Rs. 7,01,507/-. NHAI had objected for extending the line as OH line and hence the licensee has given an option that if the consumer wishes, they can extend the line as underground (UG) cable. The appellant along with other neighbouring consumers, the line was extended to their premises and a RMU with suitable number of feeders was installed. The licensee has charged Rs. 17,908/- as the supervision charges for the work executed by the appellant. The supervision charges have been adjusted from the deposit already made on 2017. The balance amount has not been refunded to the appellant. The appellant has filed petition to CGRF with a prayer to refund the amount with 14% compound interest and also claiming Rs. 14,00,000/-as compensation. The CGRF issued order dated 07/03/2024 stating that the respondent has to refund the excess amount collected within one month. The respondent has refunded the amount of Rs. 6,83,599/- without any interest. The petition is filed to this authority as appeal to the CGRF order.
P/018/2024- M/s Bharat Petroleum Corporation Ltd

The appellant M/s Bharat Petroleum Corporation Ltd is a Public Sector undertaking engaged in refining and marketing of petroleum products in India. M/s BPCL is on EHT consumer of the licensee KSEBL availed power for the storage, pumping through pipe lines and filling to tank wagon and tank lorry. The tariff applied to the consumer no. LCN -16/1666 is EHT industrial tariff. When the licensee inspected on later it is found there is no manufacturing allied activities are carried out there. As this is only a storage cum dispatch unit, the tariff has been changed retrospectively to EHT commercial. The short assessment was prepared for Rs.7,74,63,150/- for a period from 01/05/2013 to 31/07/2023 and demand notice has been sent to the appellant. The appellant objected the re-categorization and filed the petition to CGRF. The CGRF issued order on 06/03/2024 stating that the tariff decided by the licensee is appropriate and the appellant is liable to pay the amount as per short assessment bill. Aggrieved by the decision of the CGRF, this appeal petition is filed to this authority.
P/017/2024- M/s Bharat Petroleum Corporation Ltd

The appellant M/s Bharat Petroleum Corporation Ltd is an Extra High Tension Consumer of the Licensee, KSEBL. This connection was availed for their fuel pumping station situated at Irumpananm, Ernakulam. M/s Bharat Petroleum Corporation Ltd. is a public sector undertaking engaged in Refining and marketing of petroleum products. The Irumpanam facility is for storing the fuel which is pumping from Kochi Refinery which is also a unit of M/s BPCL. There are separate tanks for petrol, diesel and kerosene. The EHT connection with connected load 2634 kW and contract demand 2.6 MVA with consumer no. LCN-15/3809. There are different high capacity HT pumpsets for pumping the petroleum products to their storage facility at Coimbatore and Karur. This is pumped through the Cochin- Coimbatore- Karur Pipeline which was commissioned on 2002. This service connection was charged under EHT industrial tariff. On inspecting the premises by the officials of the licensee, it is noticed that there is no manufacturing/allied activities are happening and hence the tariff applied is not correct and the applicable tariff would be EHT commercial. The short assessment on the basis of tariff change for a period from 01/05/2013 to 31/07/2023 is worked to Rs. 34,09,90,839. The demand notice for this short assessment was issued to the appellant on 27/12/2023. The appellant has filed the petition to CGRF contenting the action of licensee and CGRF issued order on completing the procedures which states that the appellant is liable to pay the short assessment amount and the tariff applicable is EHT commercial. The aggrieved appellant has filed the appeal petition to this authority.
