The appellant Shri. Salim D.M. is the Scretary of MES, which is running an educational institution at Edathala Ernakulam in the name M.K. Mackar Pillay College for Advanced Studies. This is a self financial institution and is consumer to the licensee (KSEBL) under the tariff LT VI F. The consumer was billing under wrong tariff LT VI A for a period from 09/2009 to 07/2017. During this period the Kerala State Electricity Regulatory Commission has changed the tariff of self financing institution three times.The wrong tariff application was detected by the Regional Audit office during the audit conducted on 28/10/2022 and accordingly the short assessment bill issued to the consumer on 01/03/2023 for an amount of Rs. 4,41,060/-. The appellant has challenged the bill before the CGRF Central Zone and CGRF issued the order on completing the proceedings dated 04/08/2023. Aggrieved by the decision of CGRF, this appeal petition is filed to this authority.

The appellant availed an electric connection from the licensee (KSEBL) with consumer no. 11567220229617 from the Ollur, Electrical Section under the tariff LT VI A. The connection availed was for an Industrial Establishment with connected load of 83Kw. The meter provided is the CT connected meter with current ratio 150/5 and hence the multiplication factor 30. APTS inspection was conducted on 24/05/2018 and it was found that voltage in one phase of energy meter was missing. A standard reference meter was connected and found that the meter record only 67.56% of the actual reading. When the data was downloaded from the meter it shows that the voltage was missing for 34 times since 7/2017. A site mahazar was prepared in presence of the manager of the appellant and a copy was handed over to them. Accordingly, a short assessment was issued for Rs. 52,500/- on 11/06/2018 for the missing 1/3rd of the consumption for the period of three months from 02/2018 to 04/2018. During the audit of RAO, opined that the short assessment is to be charged for the entire period and an additional bill for Rs. 1,61,556/- was issued on 20/02/2020. Then the appellant submitted the complaint to the Vydhyuthi Adalath, then the amount was revised to Rs. 1,32,127/-. The appellant filed petition to the CGRF (CR), Ernakulam and CGRF issued order dated 18/08/2023. Aggrieved with the order of CGRF, this appeal petition was filed to this authority.

The appellant is the consumer of the licensee under Vaduthala Electrical Section and connection is availed for a Dental Clinic in LT VIG tariff with connected load 5840 w. The meter reading is taken on bimonthly basis and bills were raised accordingly. The meter reading on 08/11/2022 was 3024. The reading of January 2023 was not taken due to door lock condition and then the reading on 3rd March 2023 was 9248. Then the consumption was 6224 units (9248-3024). The bill for Rs. 54034/- was raised to the appellant. Consumer raised compliant on the bill as her bimonthly bill was between Rs. 2500/- to Rs. 4000/-. The staff of the licensee checked the energy meter but no anomalies found. The meter is tested in NABL accredited meter testing lab and no defects noticed in the meter. The consumer has been asked to check the wiring as the chance may be due to earth leakage of power. The appellant checked the wiring and no abnormalities noticed. The appellant filed the petition to the CGRF and CGRF issued order dated 27/07/2023 stating that the consumer is liable to pay the bill. Aggrieved by the order of CGRF the appellant filed this appeal petition to this authority.
