Electricity from domestic connection in the premises of the consumer was seen used to pump water to the nearby situated ice plant, owned by the consumer, under industrial tariff. Since this is a case of misuse of tariff, detected in an inspection and the consumer was issued a provisional penal bill. Consumer filed objections before the AE who revised the penal bill and later he approached the Dy. Chief Engineer, the appellate authority. The appellate authority confirmed the orders of the AE and disposed the petition accordingly. The consumer approached the CGRF who dismissed the petition stating he lacks jurisdiction in entertaining a complaint against under Section 126 and 127 of the Act.

Unauthorized use of electricity by extending supply from one building to another building in the premise of the appellant was detected by the APTS team in a surprise inspection. It is confirmed that unauthorized extension of electric supply has occurred in the premises of the appellant. As it is a case of unauthorized use of electricity under Section 126, the appeal petition is not maintainable before this Forum and disposed of accordingly.

Appellant’s brother has obtained an electric connection in his name, to a building constructed in the land actually owned by the appellant. The appellant has requested for change of ownership of the existing connection of the said building from his brother’s name to his name which was rejected by KSEB. Since the Panchayath has issued order changing the ownership of the building in appellant’s name and his brother has not disputed, it was ordered to change the name of electric connection. But the service should not be disconnected till the dispute going on in the Civil Court decides on the matter of occupancy/ownership of the said building.
