The consumer had applied for addition load in his premises after remitting required fees. There was delay in sanctioning the additional load. Meanwhile APTS conducted inspection and penalized the consumer for availing unauthorised load. Another grievance is that the consumer had applied for TOD tariff after remitting the required fees and the respondent has not raised the bills accordingly from next month onwards. Since the consumer also filed petition before the Hon. High Court for decision on the same issues of reliefs sought from here, it is held that the case is not maintainable before this Forum.

The dispute is on the average monthly bills paid by the consumer during meter faulty period as the actual consumption was very low after installing a new meter in the premises. Another demand is to refund the deposited amount in complying with the order of the Hon. High Court. It is decided that the bills of the consumer, for the last two years prior to the meter change, shall be reassessed and the excess amount paid by him with applicable interest shall be adjusted in his future bills and the respondent has been directed to implement the Hon. Court order by revising the penal bills.

The appellant was issued a provisional assessment bill for the unauthorized extension and use of additional load to his newly constructed building, consequent on a site inspection by the officials of the KSEB. The case of penal charges was settled as per the order of the Dy. CE, limiting the penal charges and adjusting the said dues. The appellant has the grievance of denial of connection to his newly constructed building, for want of clearing the old arrears. He claimed compensation for the delay occurred. The grievance on this point is found devoid of merit and hence rejected.
