The appellant shri. Bharath K Patel is the Managing Director of K.P. Cars Pvt. Ltd., which operates an Audi Car showroom situated at Kundannoor, Ernakulam. The appellant had applied for a LT connection to the licensee and had paid Rs. 3,04,653/- on 03/04/2010 as the work deposit. Then the licensee informed that as the connected load is more, HT supply is to be availed and asked them to deposit Rs. 3,96,854/-. Then the total deposit made is Rs. 7,01,507/-. NHAI had objected for extending the line as OH line and hence the licensee has given an option that if the consumer wishes, they can extend the line as underground (UG) cable. The appellant along with other neighbouring consumers, the line was extended to their premises and a RMU with suitable number of feeders was installed. The licensee has charged Rs. 17,908/- as the supervision charges for the work executed by the appellant. The supervision charges have been adjusted from the deposit already made on 2017. The balance amount has not been refunded to the appellant. The appellant has filed petition to CGRF with a prayer to refund the amount with 14% compound interest and also claiming Rs. 14,00,000/-as compensation. The CGRF issued order dated 07/03/2024 stating that the respondent has to refund the excess amount collected within one month. The respondent has refunded the amount of Rs. 6,83,599/- without any interest. The petition is filed to this authority as appeal to the CGRF order. |

The appellant sri. V.M. Vijayan is a small scale farmer who is having 30 cents of land. Krishi Bhavan has extended free electricity to the appellant. The connection was effected on 1970. The land area has been reduced to 25 cents after the partition, then the Krishi Bhavan withdraw the provision of free electricity. The licensee was informed about this and accordingly the same has been communicated to the appellant. Appellant was willing to bear the current charges and as such the connection was retained. The appellant was to pay the current charges with effect from 04/2022, and he was regularly making the payment. There was outstanding from Krishi Bhavan for his connection and surcharge also accumulated. When the surcharge accumulated was not paid, the licensee disconnected power. Then the appellant was forced to make the payment of Rs. 2598/- and then the connection was resumed. There was no power for 13 days and this affected his crops. Aggrieved appellant approached CGRF and CGRF issued order on 19/03/2024. As his grievance was not fully redressed this appeal petition is filed to this authority. |

This is the review petition filed by the appellant Sri. Markose Xavier against the order issued by this authority on the petition No. P/045/2023. The appellant is the legal heir of the consumer in Consumer No. 1145594003761. The meter display was not readable and bill issued as per the average of the consumption for the month of 07/22. The bill for 09/22 also issued based on the average reading and the status mentioned was door lock condition. The meter is installed outside the house and hence the door lock condition is not applicable. The bill on 02/11/2022 also issued in the same pattern. The meter was replaced only on 04/11/2022. The licensee is not supposed to raise the bill based on average consumption more than 4 months or two billing cycles. There was considerable delay in replacing the meter. The appellant’s issue was the third bill issued by the licensee is illegal. The CGRF issued the order stating that the appellant is liable to pay the bills issued by the licensee. The appeal was filed to the Ombudsman and order was issued by this authority dated 22/11/2023. The review petition was filed by the appellant requesting to review the order on certain grounds. The case was heard on 16/02/2024 and an Interim order was issued dated 23/02/2024 directing the licensee to test the meter and download the data. The test result of the meter was reviewed only on 08/15/2024 and hence the delay in issuing the final order. |
