The appellant remitted “power factor disincentive” under the head “Other charges” for two years prior to November 2020. After the replacement of defective capacitors, the appellant requested for refund of the excess amount remitted under “Other Charges” to the Licensee. Since no action was taken by the Officers of KSEB Ltd., the appellant filed petition in CGRF, Northern Region, and the Forum in its order rejected the request of the appellant. The appellant filed this appeal petition before this Authority. There are lapses on the part of appellant in maintaining the rated values of capacitors to avoid power factor disincentives and lapses on the part of respondent to intimate the subject of low power factor to the appellant as per rules. As such, it is decided to refund the power factor penalty realized from the appellant for 12 months from 11/2019 to 10/2020, by limiting the period of refund requested by the appellant The respondent shall refund the amount realized under “other charges” or “power factor penalty” from the appellant from 11/2019 to 10/2020 within 45 days from the date of order or adjust in the future bills. The Appeal Petition filed by the appellant is allowed to this extent and the petition stands disposed of accordingly. The order of CGRF, Northern Region, Kozhikode vide OP No. 149/2020-21 dated 25-08-2021 is set aside.

The appeal petition pertains to the bill issued to the appellant for a period of more than 4 years towards the difference in tariff category, stating the institution run by the appellant is a self-financing institution. The appellant challenged the bill before the Licensee, then before CGRF and the Forum in its order decided not to interfere the subject since the same subject was analyzed and reviewed by various eminent legal authorities including Hon’ble Supreme Court of India and there are various Regulations which made the Licensee eligible for claiming the undercharged bill under dispute with surcharge. The tariff allotted at the time of providing electric connection to the premises on 05-02-2002 was LT VIB under the remark’s private institution / private hospital and the present tariff being billed under LT VIF tariff with remarks private hospital. In the inspection, it is found that the institution is not a hospital, but training centre for certain field having no continuous in nature. As such, it is decided to quash the short assessment bill issued to the appellant for Rs.4,94,278/-. The respondent shall reassign the tariff of the institution under LT VIC tariff from the date of this order and issue the bill accordingly. The respondent shall inspect the premises and look into the possibility of providing two separate electric connections for the Amos Centre and the nearby office under appropriate tariff, till then LT VIC tariff shall be continued. The order of CGRF dated 16-04-2021 in OP No.113/2020 is set aside.

The appellant received an electricity bill on 23-04-2021 from the respondent for an amount of Rs.1,53,474/- stating that 17889 units of energy was consumed by the appellant. The appellant approached Consumer Grievance Redressal Forum and the Forum in its order dismissed the petition with a remark that if the petitioner approaches the Licensee for availing instalment facility, the same may be granted as per rules. The appellant filed this appeal petition before this Authority. It is decided to quash the electricity bill dated 23-04-2021 for Rs.1,53,474/- issued to the appellant. The respondent shall issue a revised bill for the same period taking the average of the three bi-monthly energy consumption from 23-04-2021 within 15 days from the date of order. The order of CGRF, Central Region in OP No.13/2021-’22 dated 13-08-2021 is set aside.
