പരാതിക്കാരനായ ശ്രീ. പൗലോസ് മേലൂർ ഇലെക്ട്രിക്കൽ സെക്ഷൻ പരിധിയിൽപ്പെട്ട കൃഷി സ്ഥലത്തേക്ക് കൃഷി ആവശ്യത്തിനായി വൈദ്യതി കണക്ഷൻ ലഭിക്കുന്നതിന് വേണ്ടി അപേക്ഷ സമർപ്പിച്ചു. ലൈസൻസിയുടെ ഉദ്യോഗസ്ഥൻ സ്ഥലപരിശോധന നടത്തുകയും എസ്റ്റിമേറ്റ് നൽകുകയും ചെയ്തു. സർവീസ് കണക്ഷൻ എടുക്കേണ്ട പോസ്റ്റ് റോഡിന്റെ മറുവശത്തായതിനാൽ wp വയറിന് സപ്പോർട്ട് ആയി ഒരു പോസ്റ്റ് സ്ഥാപിക്കേണ്ടതുണ്ട്. എന്നാൽ മാത്രമേ വാഹന ഗതാഗതം ഉള്ള റോഡിൽ നിയമപ്രകാരമുള്ള ഉയരം ലഭ്യമാകുകയുള്ളു. പരാതിക്കാരൻ സ്ഥാപിച്ചിട്ടുള്ള pump room ന്റെ ഉയരം കുറവായതിനാൽ തന്നെ തറ നിരപ്പിൽ നിന്നുള്ള ഉയരപരിധി നിലനിർത്താൻ പോസ്റ്റ് വേണ്ടതാണെന്നും ലൈസൻസി അറിയിച്ചു. അധിക പോസ്റ്റ് നിർത്താതെ തന്നെ പരാതിക്കാരന് നേരിട്ട് പമ്പ് ഹൌസിലേക്ക് കണക്ഷൻ വേണമെന്നതാണ് ആവശ്യം. അത് നടത്തിക്കൊടുക്കാൻ ലൈസെൻസി തയാറാവാത്തതിനാൽ പരാതിയുമായി CGRF ൽ എത്തി കേസ് പരിശോധിച്ച് നടപടി പൂർത്തിയാക്കി CGRF ന്റെ ഉത്തരവ് 28/05/2024 ൽ ഇറങ്ങി. അതുപ്രകാരം പോസ്റ്റ് നിർത്തിക്കൊണ്ട് സർവീസ് കണക്ഷൻ വലിക്കുന്നതിനും, ഈ ചെലവ് പരാതിക്കാരൻ വഹിക്കണമെന്നും പ്രതിപാദിച്ചിരിക്കുന്നു. അതിൽ തൃപ്‌തനാകാതെയാണ് പരാതിക്കാരൻ അപ്പീൽ പരാതി ഓംബുഡ്സ്മാൻ സമക്ഷം സമർപ്പിച്ചിരിക്കുന്നത്.

The appellant Shri. Joe Francis is having a plot of 9 cent land at Parappukkara in Thrissur District. The entire family was residing in Mumbai for several years. During the absent of the property owner and without obtaining the consent, the Licensee had installed a stay wire in side the property. The appellant had constructed a residential building in the property to live in the native place.The stay wire is obstructing the construction of compound wall. The appellant approached the section office of the Licensee for shifting this stay wire. They have demanded Rs. 8433/and subsequently revised to Rs.12,547/- towards the cost of shifting. The petition is filed to CGRF for a favourable order that the stay wire is to be shifted at the cost of the Licensee as the same was placed without the consent.The CGRF issued order on 17/04/2024 stating that the Licensee shall shift the post and stay wire at the cost of the appellant. Aggrieved by the decision of CGRF this appeal petition is filed to this Authority.

The appellant Shri. Krishnadas P is the owner of the 4 star Hotel named Green Fields, Kaippuzhamutt, Kumarakam, Kottayam Dist. An HT service connection was availed from the Licensee (KSEBL) for running this Hotel. The power supply was connected on 08/03/2011. The consumer in Kerala is bound to pay the Electricity duty@10% of the total energy.As per the Government order dated 11/07/1986 the tourism also will be treated as Industry and all classified Hotels are eligible for this. Then Government order dated 31/08/2010 states that the Electricity Duty payable by the High Tension Industrial consumer is 10 paisa/unit instead of 10% of the energy charges.There was a dispute between the Licensee and the Hotels about the charging of this Electricity Duty and accordingly the Association of approved and classified Hotels of Kerala approached Hon’ble High Court of Kerala. Hon'ble court issued an interim order dated 13/10/2010 stating that the petitioner shall be permitted to remit the electricity bill with electricity duty @ 10 paisa per unit for energy consumed. The liability of the petitioner to pay at the rate 10% of energy charges will be decided in the writ petition. The Licensee was not extending the benefit of this order to the appellant stating that this Hotel commenced only after this court order.
