This petition was submitted to this office as the appeal petition to the order of CGRF Southern Region dated 20/06/2024. The complainant to the petition to the CGRF was Mr. Kurian Antony, New Galaxy Theater, Mundakkayam. The order was issued to Mr. Kurian Antony. The consumer here in this connection is also seen to be Mr. Kurian Antony and the Electricity bills are issued in the name of Kurian Antony. The statement of fact submitted by the respondent AEE, Kanjirappally also states that the consumer is Mr. Kurian Antony. This appeal petition is submitted by Shri. Sunil Thomas as the Managing Director of New Galaxy Theatre. Then he is neither the consumer or the representative of this consumer. As per the clause 2(6) of the KSERC (CGRF) and electricity Ombudsman) Regulation 2023, the complainant is clearly defined 2(6).

പരാതിക്കാരനായ ശ്രി. കെ.എം രവീന്ദ്രൻ ലൈസൻസി (KSEBL) യുടെ മാവൂർ ഇലക്ട്രിക്കൽ സെക്ഷൻ പരിധിയിൽ വരുന്ന ഒരു ഉപഭോക്താവാണ്. കോവൂർ ഇലക്ട്രിക് സബ് ഡിവിഷന്റെ കീഴിലുള്ളതാണ് മാവൂർ സെക്ഷൻ. 1165962026836 എന്ന കൺസ്യൂമർ നമ്പരിലുള്ള കണക്ഷൻ സിംഗിൾ ഫേസിൽ 420 w കണക്ടഡ് ലോഡിൽ LT 7A താരിഫിൽ 25/07/2018 ൽ നൽകിയിട്ടുള്ളതാണ്. ഒരു കടയ്ക്ക് വേണ്ടി കൊടുത്തിട്ടുള്ള കണക്ഷൻ ആണിത്. കട പ്രവർത്തന രഹിതമായതിനാൽ അടഞ്ഞു കിടക്കുകയായിരുന്നു. 25/12/2023 മുതൽ 26/02/2024 വരെയുള്ള ദ്വൈ മാസ കാലയളവിൽ മീറ്റർ 2062 യൂണിറ്റ് ഉപഭോഗം രേഖപ്പെടുത്തുകയും അതിൻ പ്രകാരം ലൈസൻസി 21,909/- രൂപയുടെ ബിൽ നൽകുകയും ചെയ്തു. ഉപഭോക്താവിന്റെ പരാതിയുടെ അടിസ്ഥാനത്തിൽ ലൈസൻസിയുടെ ഉദ്യോഗസ്ഥർ സ്ഥല പരിശോധന നടത്തുകയും അടച്ചിട്ട കടയുടെ സീലിംഗിൽ കാണുന്ന വയറിൽ short circuit മൂലമായിരിക്കാം ഇത്രയും ഉപഭോഗം രേഖപ്പെടുത്തിയിട്ടുള്ളതെന്നും റിപ്പോർട്ടിൽ പരാമർശിച്ചിരിക്കുന്നു. പരാതിക്കാരൻ CGRF ൽ പരാതി സമർപ്പിക്കുകയും, CGRF നടപടികൾ പൂർത്തിയാക്കി 25/2/2024 ൽ ഉത്തരവ് പുറപ്പെടുവിക്കുകയും ചെയ്തു. ആ ഉത്തരവിന്റെ അപ്പീലായിട്ടാണ് ഈ പരാതി ഓംബുഡ്സ്മാൻ സമക്ഷം സമർപ്പിച്ചിരിക്കുന്നത്.

അപ്പീൽ പരാതിക്കാരനായ ശ്രി. ജി ഐസക് ലൈസെൻസി KSEBL ന്റെ ഉപഭോക്താവല്ല. കൺസ്യൂമർ നമ്പർ : 1155224023262 ആയി എടുത്തിട്ടുള്ള ഗാർഹിക കണക്ഷൻ ശ്രീമതി. സിജി നൈനാൻ, മേപ്പളളിൽ പുത്തൻവീട്ടിൽ, ഈരേഴ സൗത്ത്, ചെട്ടികുളങ്ങര എന്നയാളുടെ പേരിലുള്ളതാണ്. ഉപഭോക്താവ് പരാതിക്കാരനെ അധികാരപ്പെടുത്തിയിട്ടുള്ളതോ നോമിനി ആക്കിയിട്ടുള്ളതോ ആയ രേഖകൾ ഒന്നും തന്നെ സമർപ്പിച്ചിട്ടില്ല. CGRF ലും ഇലക്‌ട്രിസിറ്റി ഓംബുഡ്മാൻ ഉം ആർക്കൊക്കെ പരാതി സമർപ്പിക്കാം എന്നുള്ളത് കേരള സ്റ്റേറ്റ് ഇലെക്ട്രിസിറ്റി റഗുലേറ്ററി് കമ്മീഷൻ (CGRF and Electricity Ombudsman) റെഗുലേഷൻ 2023 ലെ clause 2 (6) ൽ വിശദമായി വിവരിച്ചിരിക്കുന്നു.
