As per appellant, the premises is a rental building and there is no continuous occupancy in the building. The faulty meter in the premises was not changed and during the period, the appellant remitted the bill amount issued by the respondent. Later, as per the report of Audit Wing of the Licensee, the bimonthly average consumption of the appellant was revised from 296 units to 546 units and issued the short-assessment bill for Rs.4,222/- for 4 billing cycles. The appellant filed a petition before CGRF, Central Region, for the cancellation of the short-assessment bill and against the disconnection notice issued by the respondent. The Forum issued order dismissing the petition. The appellant filed this appeal petition before this Authority. The reassessment bill for Rs.4,222/- is quashed. If the amount is remitted by the appellant¸ the amount shall be adjusted in the future bills. The appeal petition filed by the appellant is having merits and hence, allowed. The order of CGRF, Central Region in OP No.21/2021-22 dated 15-09-2021 is set aside.

An electric pole carrying a Low Tension (LT) 4 wire overhead line got damaged following the falling of a line branch from the property of the appellant. The appellant remitted Rs.4,433/- towards material cost and Rs.4,500/- towards the labour charge paid to the contractor who carried out the works. The appellant approached the Licensee for the refund of the amount, but no action was taken and hence, filed a petition before CGRF, Central Region and the Forum rejected the request of the appellant. The appellant filed this appeal petition before this Authority. The appellant had to intimate the Licensee about the cutting and removing of branches of the tree for taking safety precautions by the Licensee. At the same time, Licensee had to maintain the Low-Tension line properly and to strengthen the weak points in the distribution network. As such, the respondent shall bear the material cost and the appellant shall bear the labour charge. The respondent is directed to refund the material cost remitted by the appellant within 30 days from the date of order. The order of CGRF, Central Region in OP No.15/2021-22 dated 01-09-2021 is set aside. The appeal petition filed by the appellant is allowed to this extent.

The appellant received the usual bimonthly electricity bill on 26-06-2020 amounting to Rs.3,327/- for an energy consumption of 741 units. The appellant requested for a revision of the bill amount for an average consumption of 120 units. Since no action was taken by the Assistant Engineer on the subject, the appellant filed a petition before CGRF, Southern Region, but the Forum rejected the petition with an instalment facility. The appellant filed this Appeal Petition before this Authority. The appeal petition filed by the appellant stands dismissed. The order of CGRF, Southern Region dated 07-09-2021 in OP No.41/2021 is upheld. The respondent shall not realize any interest on surcharge for the balance bill amount to be remitted by the appellant in the period of petition pending before CGRF, Southern Region and the appeal petition before this Authority.
