The APTS team has detected unauthorized additional load in the premises of the consumer and also found that the inputs from R & Y phase currents given to the CT meter were absent thus resulting in the recording of lower consumption. The consumer was issued a short assessment bill to recover the energy escaped from billing due to CT’s fault in two phases. Respondent has been directed to revise the disputed bill based on average energy consumption per month, giving credit to the energy units already billed.

The inspection conducted by KSEB officials revealed that the electric connection was not used for any manufacturing activities. Based on the mahazar, the KSEB changed the tariff to commercial and raised short assessment bills on the consumer. In this case, the question to be decided is, ‘whether the activities of the appellant in the case under dispute warrant an industrial tariff or a commercial tariff? It is held that the appellant is eligible for industrial tariff.

The appellant has applied for electric power to his new industrial unit and paid necessary fees for the same. The Asst. Engineer sought clarification from Dy. CE on the maintainability of giving electric connection for a new industry in a place, separated by a wall only, where there existed already 4 numbers of similar LT industrial connections that manufacture the same product, under the same ownership. The respondent declined to grant power as the DCE directed to advice the applicant to take a HT connection combining all units. Disposed the case with direction to respondent to provide the electric connection as applied by the appellant observing the rules in force.
