On the basis of an inspection by KSEB, the consumer was issued with penal bill for tariff misuse, unauthorized additional load and unauthorized extension of supply and booked under Sec.135 of Ele. Act, 2003. The supply was disconnected under Sec. 135 and bill issued under Section 126 of Electricity Act 2003. It is found that the respondent has exceeded their powers in booking the case under Section 135 of the Act, and raising the bill for the offence of unauthorized use of electricity. The case has been remanded to the Assessing Officer to review the same and decide afresh as per law, as it is not maintainable before the Forum.

The energy consumption of the consumer for two months has reached a high level and the consumer was issued a very high electricity bill under the domestic tariff. The disputed bill is quashed and the respondent is directed to revise it at par with the maximum energy used bill (not disputed) during the previous months.

The energy consumption in one phase is not recording in the meter and also detected unauthorized additional load in the premises of the consumer. To recover the revenue loss, the consumer was issued short assessment bill assessing the energy escaped from billing as 1/3rd and to recover penal charges for unauthorized use of energy for 1 KW by KSEB. In the case of short assessment bill during meter faulty period, it is directed to revise the bill based on the average consumption during the previous period. In the case of the penal bill for the UAL , the Forum not considered the merits of the issue since section 126 of Electricity Act will not fall under the purview of the Forum.
