The APTS inspection has revealed that one phase is not recording energy in the meter of the consumer and a short assessment bill issued to recover the escaped units from billing. The data downloaded from the meter established conclusively, the date of missing of the supply and its period. It is held that the consumer is bound to pay the electricity charges for the actual energy he has consumed and hence the petition was dismissed.

It was detected by the APTS,KSEB that the energy used in one phase of supply of the party was not recording in the meter. The consumer was issued with a short assessment bill for the back period of one year to recover the charges of the unrecorded portion of the energy assessing at 50% of the consumption recorded. The respondent was directed to revise the disputed bill, taking the succeeding six months average consumption after changing the meter as his true average consumption for the disputed period of one year.

Based on an inspection conducted by the officials of KSEB, the consumer was issued with a short assessment bill for the unauthorized additional load detected in the premises. It is held that the appeal petition is not maintainable before the Ombudsman since it was charged under Section 126, unauthorised use of electricity. It is found that the penal bill raised by the respondent is against the method ordered by the KSERC and hence the case remanded to the assessing officer to review the same.
