The appellant is the Director of Geological Survey of India, office situated at Manikanteshwaram, Thiruvananthapuram. The Geological Survey of India, Trivandrum is a Consumer of Licensee under their Electrical Section, Kachani, Thiruvananthapuram and the tariff applicable is LT 6B. On 21/12/2023, the Anti Power Theft Squad of Licensee had conducted an inspection and found that the connection of secondary sides of CTs are interchanged between R & B phases causing an error under recordings of the energy consumption. The under recording was around 44% less of the actual consumption. A short assessment for Rs. 22,25,660/- for a period from 2013 to 2023. The appellant has disputed the Short Assessment Bill and the petition is filed to the CGRF. CGRF had issued the order dated 18/09/2024 on completing the procedures. This petition is filed to this office as the appeal to the CGRF order as appellant is aggrieved by the decision of CGRF.

കൃഷ്‌ണപുരം ഇലക്ട്രിക് സെക്ഷന്റെ കീഴിൽ പുതുപ്പള്ളിയിൽ ഒരു ധാന്യ മിൽ പ്രവർത്തിപ്പിക്കുന്നതിന് വേണ്ടി നൽകിയിട്ടുള്ള Consumer No . 1145683009846 എന്ന കണക്ഷൻ ശ്രീ. വാസുദേവൻ ഉണ്ണിത്താൻ എന്നയാളുടെ പേരിലാണ്. ഈ വസ്തുവിന്റെയും അതിൽ സ്ഥിതി ചെയ്യുന്ന മില്ലിന്റെയും ഇപ്പോഴത്തെ അവകാശി ശ്രീമതി. സുകുമാരി.പി, ഹരിവിലാസം, പുതുപ്പള്ളി എന്ന വ്യക്തിയാണ്. 1992 ൽ ശ്രീമാൻ. വാസുദേവൻ ഉണ്ണിത്താൻ വിലയാധാരമായാണ് പരാതിക്കാരിയ്ക്ക് നൽകിയത്. അതിനു ശേഷം പരാതിക്കാരിയാണ് വസ്തുവിനും കെട്ടിടത്തിനും കരം ഒടുക്കിവരുന്നത്. വിലയാധാരത്തിന്റെയും കരം ഒടുക്കു രസീതിന്റെയും പകർപ്പുകൾ നൽകിയത് പരിശോധിച്ചതിൽ നിന്നും ഇത് വ്യക്തമാകുന്നു. പ്രസ്തുത സർവീസ് കണക്ഷന്റെ മീറ്റർ റീഡിംഗ് 01/03/2023 ലും 0`1/04/2023 ലും 2/05/2023 ലും എടുക്കുകയും അതിനനുസരിച്ച് നൽകിയ ബില്ല് പ്രകാരം പരാതിക്കാരി തുക ലൈസൻസിയുടെ ഓഫീസിൽ അടയ്ക്കുകയും ചെയ്തു. Door Lock എന്ന കാരണം കാണിച്ച് 02/05/2023 ലെ റീഡിംഗിനു ശേഷം പിന്നെ റീഡിംഗ് എടുത്തത് 11/01/2024 ൽ മാത്രമാണ്. അപ്പോൾ ഉയർന്ന'ഉപഭോഗം അതായത് 13483 യൂണിറ്റ് മീറ്റർ രേഖപ്പെടുത്തിയതിൻ പ്രകാരം 88,309/- രൂപയുടെ ബിൽ നൽകുകയുണ്ടായി. പ്രവർത്തനമില്ലാതെ അടഞ്ഞുകിടക്കുന്ന സ്ഥാപനത്തിൽ ഇത്രയും ഉപഭോഗം ഉണ്ടാകാൻ സാധ്യതയില്ല എന്ന പരാതിക്കാരിയുടെ നിവേദനത്തിന്റെ അടിസ്ഥാനത്തിൽ മീറ്റർ പരിശോധിക്കുകയും, മീറ്റർ പ്രവർത്തനക്ഷമമാണെന്ന് Licensee ഉറപ്പിക്കുകയും ചെയ്‌തു. പരാതിയ്ക്ക് പരിഹാരം ഉണ്ടാകാത്തതിനാൽ CGRF ൽ പരാതി നൽകുകയും CGRF നടപടികൾ പൂർത്തിയാക്കി 03/09/2024 ൽ ഉത്തരവിറക്കുകയും ചെയ്തു. പ്രസ്തുത ഉത്തരവിന്റെ അപ്പീലായിട്ടാണ് ഈ പരാതി ഓംബുഡ്‌സ്മാൻ സമക്ഷം സമർപ്പിച്ചിരിക്കുന്നത്.

The appellant Shri. Viswanathan.G is the owner of the Partha Movie House, situated at Kallam thazham Junction and he is a Consumer of the Licensee under Electrical Section, Kilikolloor. The power availed for the Movie House is LT 3 Phase in LT 7C tariff with contract demand of 95KVA and connected load 122.372 KW with Consumer No. 1145645006423. This connection was availed prior to 2005. The consumer had exceeded the maximum demand above 100KVA during 05/2019, 06/2019, 07/2019 and 08/2019 and the Licensee had issued bill for Low voltage surcharge for Rs. 1,36,485/-. The consumer has been remitted this amount. Again the demand had crossed 100KVA during the month 09/2019, 01/2022, 04/2022, 05/2022, 08/2022, 09/2022, 03/2023, 04/2023 & 05/2023, and accordingly a bill for the low voltage surcharge was issued for Rs. 2,59,240/-. The appellant had objected this bill and filed petition to the CGRF. The CGRF issued the order dated 17/11/2023 on completing the procedures. Then the appellant had approached the KSERC for the Redressal of the grievance and the KSERC directed to file appeal petition vide letter dated 01/10/2024. Appellant had filed this appeal as per the direction of the KSERC vide letter dated 01/10/2024.
