The appellant Shri. Rajendran resident of Sakthikulangara, Kollam is a Consumer under the Electrical Section, Sakthikulangara. He had applied for an Electric Connection for purpose of cultivating various crops and vegetable in his land. His application was rejected without proper reasons and the Assistant Engineer was not allowed him to remit the application fee. Then he had send the application fee by DD and this has been accepted. The application was valid on 05/07/2022. The Licensee had conducted an inspection without notice to the Consumer and had sent an inspection report and the appellant had replied vide his letter dated 01/08/2022. Then again the officials of the Licensee had reported that they have conducted various inspections and send letters after letters.The connection was denied stating that the location of meter is not easily accessible, the alignment of service line is not on accessible route and no shelter have been provided for the meter. The appellant states that the Licensee had made indefinite delay on providing the connection. The appellant had filed petition to the CGRF and CGRF issued order dated 29/07/2024 on completing the procedures. This petition is filed as the Appeal to the order of CGRF.

The appellant Shri. Shajan. N.P Njalil House, is a Consumer of the Licensee KSEBL with Consumer No. 1157482007946 under the Electrical Section Mulanthuruthy. Appellant had availed power supply for the construction of an apartment building under the tariff 6 F. The building is having 5 apartment and had applied for 5 service connections. On inspection the officials of the Licensee had found that only one apartment in ground floor is using for the residential purpose. The other 4 apartments were used as a Hostel for boys. Then the Licensee has given one residential connection under tariff LT 1A which is used for the residential purpose. The connection under 6 F was used for powering the Hostel apartment. The Licensee had conducted an inspection on 30/06/2023 and found that unauthorised load is connected and accordingly they made an assessment for Rs.1,56,530/- . The consumer has filed appeal to the electricity appellate authority, and appellate authority had set aside the short assessment. Then the Licensee had converted the LT 6 F Connection to LT 7 A Connection as the single point supply to the Hostel.The consumer has filed the petition to CGRF and CGRF issued order dated 22/08/2024. This petition is filed to this office as the appeal petition to the order of CGRF.

This petition was filed as the Review petition to petition P/052/2024 for which the Ombudsman had issued order on 9/10/2024. The complainant to the petition submitted to CGRF was Shri. Kurian Antony, New Galaxy Theatre, Mundakkayam. The CGRF order also issued in the name of Shri. Kurian Antony. The appeal to the Kerala State Electricity Ombudsman was submitted by one Shri. Sunil Thomas as the Managing Director of New Galaxy Theatre. The petitioner is not a consumer or the legal heir of the consumer as per the KSERC(CGRF and Ombudsman ) regulation 2023. 2(6) “Complainant” means any person who submits the complaint or grievance or representation as defined in these regulations against the distribution licensee and include the following: (i)any consumer of electricity supplied by the licensee as defined under clause ( 15) of section 2 of the Act, including applicants for new connections; or (ii)a voluntary electricity consumer association/ forum or other body corporate or group of electricity consumers; or (iii)the Central Government or State Government - who or which makes the complaint; or (iv) in the case of death of a consumer, his legal heirs or representatives; The petitioner has failed to submit any document showing that he is the Consumer or Legal heir of the consumer. Accordingly the petition has been rejected and disposed. The Review Petition has been filed to review the decision of the Order of Ombudsman in petition P/52/2024. The petitioner has submitted the review petition stating that he is the Managing Director of the New Galaxy Theatre. Then why the petition to the CGRF was filed by Shri. Kurian Antony, who is the consumer as per record? This could been answered the petitioner.
