അപ്പീൽ പരാതിക്കാരനായ ശ്രീ.ബിജു ടോം, എന്ന വ്യക്തി “Style Pala Metal Products” എന്ന സ്ഥാപനത്തിന്റെ ഉടമസ്ഥനാണ്. പരാതിക്കാരന് 18-06-2003 ന് താരിഫ് LT 4 A പ്രകാരം കൺസ്യൂമർ നമ്പർ. 1156243014607ൽ 129.834 KW connected load ഉളളതും, 03/04/1998 ന് താരിഫ് LT 7 A പ്രകാരം കൺസ്യൂമർ നമ്പർ. 115624012073ൽ 150 W connected load ഉളളതുമായ രണ്ട് സർവീസ് കണക്ഷൻ ലഭിച്ചിരുന്നു. പരാതിക്കാരൻ ലൈസൻസിയെ അറിയിക്കാതെ ക്രഷർ യൂണിറ്റിന്റെ പ്രവർത്തനം നിർത്തിവച്ചു. ലൈസൻസി 01/2020 മുതലുളള fixed charge മാത്രമാണ് പരാതിക്കാരനിൽ നിന്ന് ഈടാക്കിയത്. വൈദ്യുതി വിഛേദിക്കാൻ ഉപഭോക്താവിന്റെ പക്കൽ നിന്നും യാതൊരു അഭ്യർത്ഥനയും ഉണ്ടായിട്ടില്ല. പേയ്മെന്റ് വീഴ്ച വരുത്തിയെങ്കിലും കോവിഡ് 19 കാരണം വൈദ്യുതി വിഛേദിക്കാൻ താമസം നേരിട്ടു. 17/06/2022 ന് കണക്ഷൻ നമ്പർ.14607 ഉം 30/11/2021 ന് കണക്ഷൻ നമ്പർ.12073 ഉം വിഛേദിച്ചു. വൈദ്യുതി ഉപഭോഗം ഇല്ലാതിരുന്ന സമയങ്ങളിൽ fixed charge മാത്രം ലൈസൻസി ആവശ്യപ്പെടുകയുണ്ടായി. പരാതിക്കാരനിൽ നിന്ന് ഉണ്ടായ കുടിശ്ശികയുളള ചാർജ് ഈടാക്കാൻ ലൈസൻസി നടപടി സ്വീകരിച്ചു. ശേഷം പരാതിക്കാരൻ CDRC യെ സമീപിക്കുകയും CDRC പരാതി തളളിക്കളഞ്ഞതിനെത്തുടർന്ന് CGRF നെ സമീപിക്കുകയും 02/12/2024 ൽ CGRF പരാതിക്കാരൻ ബില്ലിന് അനുസൃതമായുളള തുക അടയ്കാൻ ബാധ്യസ്ഥനാണെന്നുളള ഉത്തരവ് പുറപ്പെടുവിക്കുകയും ചെയ്തു. ഈ ഉത്തരവിൽ സംതൃപ്തനല്ലാത്തതിനാലാണ് പരാതിക്കാരൻ ബഹു.ഓംബുഡ്സ്മാൻ സമക്ഷം ഈ പരാതി സമർപ്പിച്ചിട്ടുളളത്.

The appellant is the Secretary of Kilimanoor Grama Panchayath. The appellant has requested the Licensee for the installation of 376 new single tube lights at various locations as part of augmentation of the street lighting system and remitted Rs.49,250/- towards the supervision charges. The lights were installed during 2008. The street lights were installed as un metered system. The License had omitted to add the new street lights fittings for the billing. This omission was found out during the audit conducted by Regional Audit Officer on 23/02/2011. Though the mistake of omission in billing was found out during 2011, the demand for the under charged amount was raised only on 29/03/2014. Then a joint inspection was carried out by Panchayath and Licensee and accordingly the bill was revised to Rs.6,11,082/- and issued on 20/02/2015. The appellant contented that the bills were raised after three years of detecting the mistake as such as per 56(2), the demand issued by the Licensee is not valid due to the limitation period of two years. The appellant had filed the petition to CGRF and CGRF issued order dated 10/12/2024, stating that the appellant is liable to pay the amount as per the revised bill.

The appellant Shri.C.P Prabhakumar is the owner of the Coastal Breeding Farm (Pvt.) Ltd. at Vannamada, Palakkad with Consumer no. 1165020021296. The said connection was taken as a temporary in LT VII A tariff for the construction purpose with connected load 6.89KW in the name of Mr. Ramakrishnan which was connected on 29/04/2013. Later the connection was changed with the appellant, as 3 phase LT, with connected load 44.459 KW with contract demand of 20 KWA. The tariff applied was changed from LT 7A to LT 4A as per the request of the consumer on 10/01/2014. The appellant was running a duck hatchery and produce day old duckling and selling outside. The certificate issued by the District Industries Centre states that the industry is Hatchery. The Licensee issued by Eruthempathy Panchayath as well as in Kerala State Pollution Control Board also states that the unit is Hatching the Duck egg and produces daily one ducklings. The Licensee had applied the tariff LT IV A, and latter changed into LT V B based on the request of the consumer and conducting inspection on 06/08/2023. The allegation of the appellant is that the Licensee would have applied the tariff since 10/01/2014. Itself, Or would have changed by the Licensee on suo motto as per regulation 97 of the Supply Code, 2014. The appellant had filed the petition to the CGRF and CGRF in order on completing the procedures on 11.11.2024. The Aggrieved the appellant had filed this petition as appeal to the order of CGRF.
