The appellant is a company existing in Kanjikode industrial area and represented by its Managing Partner Shri. Asrudeen. The connection with Consumer No. 1165280017556 was effected on 09/11/2012 in the name of K.V Ratheesh, Temco Electricals and Electronic Devices (Pvt.) Ltd.under LT IV tariff with connected load of 41KW. On 16/08/2018 they have applied for the transfer of ownership to the present consumer and the connected enhanced to 89 KW and accordingly these effected in the month of 08/2018. On 02/07/2024 an inspection was conducted by AE, of Electrical section and found that the process what is happening in the factory is not eligible for tariff LT IVA and accordingly the tariff has been changed LT VII A (commercial). As per the proceedings of the General Manager, Palakkad, Industrial Centre, the name of the company has been changed to Swaraj Bio Fuel and business also has been changed to Dehydration and Distillation of the Oil. The Licensee has raised the demand for under changed amount for a period 24 months as per the regulation 134 of the Supply code 2014. The CGRF issued order stating that the Licensee can recover the under changed amount for the whole period. Aggrieved by the order of CGRF this appeal petition is filed to this authority.

A three phase LT service connection bearing Consumer No. 1146179025563 has been given to Stephen Chacko, Pandiyalil Thiruvalla on 30/03/2019. The connected load was 53.38 KW and the purpose was for functioning of Regional Office of the State Bank of India. And the tariff was LT VIC. The occupant of the premises is the Regional Manager of SBI and the consumer has authorise the occupant to file the petition and connected proceedings. The metering was done by a CT connected meter with CT ratio 100/5. On 21/12/2023, a surprise inspection was conducted by APTS along with the officials of the electrical section and found that current in the Y phase was not recorded by the meter. Then the consumption recorded by the meter was 1/3rd less than the actual consumption. The short assessment bill for Rs.4,60,378/- has been prepared and the same is demanded from the appellant for a period from 06/2021 to 12/2023 which is for 31 months. This has been contented by the appellant and filed petition to CGRF. CGRF had issued order on 08/11/2024 on completing the procedures. Aggrieved with the order, this petition is filed as an appeal petition to the CGRF order.

പരാതിക്കാരനായ ശ്രീ. കെ.എസ്. ഗിരീഷ് ലൈസൻസിയുടെ (KSEBL) ന്റെ കടപ്പാക്കട ഇലക്ട്രിക് സെക്ഷൻ പരിധിയിൽ വരുന്ന ഒരു ഗാർഹിക ഉപഭോക്താവാണ്. കൺസ്യൂമർ നമ്പർ.1145594000783 ആയ ഈ കണക്ഷൻ 6.391KW connected load ഉള്ള 3 phase കണക്ഷൻ ആണ്. 14/03/2024 ൽ പരാതിക്കാരന് ലഭിക്കുന്ന വൈദ്യുതിയിൽ ഒരു ഫേസ് ലഭ്യമല്ലാത്തതിനാൽ തൊട്ടടുത്തുള്ള സെക്ഷനിൽ അറിയിക്കുകയും അവിടെ നിന്ന് ഉദ്യോഗസ്ഥർ വന്ന് പരിശോധിക്കുകയും ചെയ്തു. പോസ്റ്റിൽ നിന്നും വരുന്ന കണക്ഷൻ വയറിലോ മറ്റോ ഉള്ള തകരാറായതിനാൽ നാളെ പകൽ ശരിയാക്കാമെന്നും, Online ആയി ഒരു പരാതി നൽകാനും പറഞ്ഞതിനാൽ രാത്രി 9.05 ന് Online ൽ പരാതിനൽകുകയും ചെയ്തു. അന്ന് രാത്രി തന്നെ സ്വന്തം മകൾ താമസിക്കുന്ന ഹൈദ്രാബാദിലേയ്ക്ക് കുടുംബസഹിതം പുറപ്പെടുകയും ചെയ്തു.15/03/2024 ആം തീയതി പരാതി പരിഹരിച്ചു എന്ന സന്ദേശം ലഭിക്കുകയും ചെയ്തു. 15/05/2024 ൽ ദ്വൈമാസ റീഡിങ്ങ് എടുക്കുകയും ബിൽ തുകയായ Rs 1650/- ഉപഭോക്താവ് അടയ്ക്കുകയും ചെയ്തു. 16/07/2024 ൽ പരാതിക്കാരന്റെ മീറ്റർ റീഡിങ് എടുത്തപ്പോൾ ഉപഭോഗം 2893 ആണെന്ന് കാണുകയും 28,999/- രൂപയുടെ ബിൽ നൽകുകയും ചെയ്തു. അടഞ്ഞു കിടക്കുന്ന വീടായതിനാൽ ഇത്രയും അമിതമായ ഉപഭോഗം ശരിയല്ല എന്ന് കാണിച്ച് പരാതി നൽകിയപ്പോൾ AE , Sub Engineer, Oversier എന്നിവർ സ്ഥലത്തെത്തി മീറ്ററും ഉപകരണങ്ങളും പരിശോധിക്കുകയുണ്ടായി. മെയിൻ സ്വിച്ചിന്റെ അകത്ത് ഒരു ഭാഗം കത്തിയത് മൂലമുണ്ടായ Earth leakage ആകാം ഈ അമിത ഉപഭോഗത്തിനു കാരണമെന്ന അനുമാനം അറിയിക്കുകയും ചെയ്തു. മീറ്ററിൽ തകരാർ ഒന്നും കാണാത്തതിനാൽ തന്നെ ഉപഭോഗത്തിനുള്ള ബില്ല് തുക അടയ്ക്കാൻ പരാതിക്കാരൻ ബാധ്യസ്ഥനാണെന്ന ലൈസൻസിയുടെ വാദം അംഗീകരിക്കാൻ കഴിയാത്തതിനാൽ CGRF ൽ പരാതി നൽകുകയുണ്ടായി. നടപടികൾ പൂർത്തിയാക്കി CGRF 11/11/2024 ൽ ഉത്തരവിറക്കി ആ ഉത്തരവിനെ ചോദ്യം ചെയ്തുകൊണ്ടുള്ള അപ്പീലായിട്ടാണ് ഈ പരാതി ഓംബുഡ്സ്മാൻ സമക്ഷം നൽകിയിട്ടുള്ളത്.
