| The consumer who was running an industrial unit defaulted electricity charges due to loss and therefore the service was disconnected. Later the consumer’s power supply was restored based on Hon: High Court order. The consumer informed the Board that she is not in a position to run the industry due to mounting loss and requested to dismantle the supply. Even though supply was disconnected, it was not dismantled, due to filing of a case at Munsiff court. Thereafter the dismantling of connection was done and RR action initiated. What is the arrears of electricity charges actually payable. This was the cause for the petition. |

| അപ്പീല്‍ പരാതിക്കാരനായ ശ്രീ ജോണ്‍സണ്‍ ജോര്‍ജ് കരുവാളൂര്‍ ഇലക്ട്രിക്കല്‍ സെക്ഷനിലെ 6992 നമ്പരായി രജിസ്റ്റർ ചെയ്തിട്ടുള്ള വൈദ്യുതി ഉപഭോക്താവാണ്. അപ്പീല്‍ പരാതിക്കാരന്റെ വീടിന്റെ മുറ്റത്ത് അനധികൃതമായും നിയമവിരുദ്ധമായും സ്ഥാപിച്ചിട്ടുള്ള TVMK-133 നമ്പര്‍ ഇലക്ട്രിക് പോസ്റ്റ് തൽസ്ഥാനത്തു നിന്ന് മാറ്റി റോഡരികില്‍ സ്ഥാപിക്കുവാന്‍ വേണ്ടിയാണ് പരാതി നല്‍കിയത്. ഇതേ ആവശ്യത്തിലേക്കായി പരാതിക്കാരന് കണ്‍സ്യൂമര്‍ ഗ്രീവന്‍സ് റിഡ്രസ്സല്‍ ഫോറം, കൊട്ടാരക്കര മുമ്പാകെ അപ്പീല്‍ നല്‍കുകയും ടി അപ്പീലില്‍ OP-1657/2015 ആയി നല്‍കിയ ഉത്തരവില്‍ സാങ്കേതിക വശങ്ങള്‍ പരിശോധിച്ച് പോസ്റ്റും ലൈനും മാറ്റി സ്ഥാപിക്കുന്നതിന് ആവശ്യമായ പ്രവര്‍ത്തിചെലവ് പരാതിക്കാരനില്‍ നിന്ന് ഈടാക്കിയതിനു ശേഷം പ്രസ്തുത ജോലികള്‍ ചെയ്തു തീര്‍ക്കുന്നതിന് തീര്‍പ്പ് കല്‍പ്പിട്ടുള്ളതാണ്. എന്നാല്‍ അപ്പീല്‍ പരാതിക്കാരന്റെ ചെലവില്‍ പോസ്റ്റ് മാറ്റിസ്ഥാപിക്കണം എന്നുള്ള CGRFന്റെ ഉത്തരവിനു എതിരായിട്ടാണ് ഇപ്പോള്‍ അപ്പീല്‍ പരാതി നല്‍കിയിട്ടുള്ളത്. സ്ഥലം ഉടമസ്ഥന്റെ അനുമതി ഇല്ലാതെ സ്ഥാപിച്ച പോസ്റ്റും ഇപ്പോള്‍ പരാതിക്കാരന്റെ വീടിനോട്‌ ചേര്‍ന്ന്‍ അപകടകരമായി വലിച്ച ലൈനും ഈ ഉത്തരവ് ലഭിച്ച് ഏഴു ദിവസത്തിനുള്ളില്‍ എതിര്‍കക്ഷിയുടെ ഉത്തരവാദിത്വത്തില്‍ മാറ്റി സ്ഥാപിക്കേണ്ടതാണ്. അപ്പീല്‍ പരാതിക്കാരന് ഈ വിഷയത്തില്‍ യാതൊരു ബാദ്ധ്യതയും ഉണ്ടായിരിക്കുന്നതല്ല. ഇതിന് വരുന്ന ചെലവ് ഏതു വിധേന ഈടാക്കണം എന്ന തീരുമാനം എതിര്‍കക്ഷിക്ക് എടുക്കാവുന്നതാണ്. അപ്പീല്‍ പരാതിക്കാരന്റെ ചെലവില്‍ പോസ്റ്റ് മാറ്റിസ്ഥാപിക്കണം എന്നുള്ള CGRFന്റെ വിധിഭാഗം റദ്ദ് ചെയ്ത് മേല്‍ ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു. മറ്റു ചെലവുകള്‍ അനുവദനീയമല്ല. |
