This review petition is filed by the Licensee against the petition P/060/2024. The petition P/060/2024 was filed by Smt. Chandralekha and Shri. V.N Saseendran as appellant in connection with the service connection bearing no.1155473008502 and the respondent was Assistant Executive Engineer, Ernakulam Central. This connection was originally in the name of V.N Sahadevan who was expired and Smt. Chandralekha was his legal heir. Now the connection was transferred to Shri.V.N.Saseendran. The property in which this connection exists was the joint property of brothers. V.N.Sahadevan and V.N.Saseendran. The domestic connection which was under the tariff LT 1 A has been changed to LT 7 A during 07/2010 by the officials of the Licensee without following the codal formalities.Then on 08/2014, the tariff has been changed to LT 6F. The appellant was complaining that the Licensee was charging higher tariff though the purpose of use was only domestic. They have started a sofa repairing unit in the premises where this connection exists during 01/2018. They have requested the Licensee for a change of tariff from LT 6 F to LT IV industrial and this was effected only on 2020. The Licensee has recovered higher amount from 08/2018 to 12/2018 as the revision of bill showing status as Door lock condition revision bill. The petition P/060/2024 has been heard in person and examined the statements and documents submitted by the parties and accordingly Order was issued by the Electricity Ombudsman on 14/11/2024. The order states as follows. 1.The tariff change implemented by the Licensee unilaterally has been cancelled. The Licensee has to revise the bill accordingly. 2.The change of tariff to LT 4 A is to be effective with effect from 01/2018. The amount excess collected from the consumer is to be refunded. 3.The D/L revision bills issued for the months 08/2018, 10/2018 and 12/2018 is cancelled and Licensee has to revise the bills as per Kerala Electricity Supply Code 2014. The excess amount collected is also to be refunded. 4.The refundable amount as per decision 1,2,3 has to be refunded with interest (to the consumer) 5.If the refundable amount is excess after adjusting the current charge payable for three months, then the amount is to be refunded by cheque(to the consumer) These refundable amount could be refunded to the registered consumer at present. It is noted that the Licensee has issued cheque for the refundable amount to the consumer (in person) which was not accepted by him. The Licensee has not sent the cheques by registered post. Then the consumer has filed petition to KSERC alleging that the order of Ombudsman is not implemented.

പരാതിക്കാരനായ ശ്രീ. ജയിംസ് കുട്ടി തോമസ് ലൈസൻസിയായ KSEBL ന്റെ വൈറ്റില ഇലക്ട്രിക്കൽ സെക്ഷന്റെ കീഴിലുള്ള ഒരു ഉപഭോക്താവാണ്. ഉപഭോക്‌തൃ നമ്പർ 1155565026062 ആയ പരാതിക്കാരൻ 11/09/2020 ൽ 5KWP സോളാർ പ്ലാന്റ് സ്ഥാപിച്ച് ലൈസൻസിയുടെ ഗ്രിഡിലേയ്ക്ക് കണക്ട് ചെയ്തു.അങ്ങനെ ഒരു prosumer ആയ ഇദ്ദേഹത്തിൽ നിന്നും FC ചാർജ് ഈടാക്കിയതിനെക്കുറിച്ചാണ് പരാതി. ലൈസൻസി 11/2022 വരെ Import ചെയ്യുന്ന യൂണിറ്റിനു മാത്രമേ FC ഈടാക്കിയിരുന്നുളളൂ. എന്നാൽ അതിനുശേഷം ലൈസൻസി FC ചാർജ് ചെയ്യുന്നത് Import ചെയ്യുന്ന വൈദ്യുതിയും സ്വയം ഉല്പാദിപ്പിച്ചുപയോഗിക്കുന്ന വൈദ്യുതിയും ചേർത്ത് ആകെയുള്ള ഉപഭോഗത്തിന് അനുസരിച്ചാണ്. KSERC യുടെ താരിഫ് ഓർഡർ നടപ്പിലാക്കാനായി ലൈസൻസി ഇറക്കിയിട്ടുളള സർക്കുലറിൽ ഇങ്ങനെയാണ് പ്രതിപാദിച്ചിരിക്കുന്നത്. കൂടാതെ ലൈസൻസിയുടെ Billing Software ആയ ഒരുമ നെറ്റിലും ഈ രീതിയിലുളള സംവിധാനമാണ് ഏർപ്പെടുത്തിയിരിക്കുന്നത്. എന്നാൽ ഇത് ശരിയല്ല എന്നും അതിന് നിയമസാധുതയില്ല എന്നും പരാതിക്കാരൻ വാദിക്കുന്നു. KSERC 2020 ൽ ഇറക്കിയിട്ടുള്ള RE&Net metering regulation പ്രകാരം net consumption ന് മാത്രമേ ചാർജ് ഈടാക്കാവൂ എന്ന് പരാതിക്കാരൻ സ്ഥാപിക്കുന്നു. ലൈസൻസി ഇത് അംഗീകരിക്കാൻ തയ്യാറല്ലാത്തതിനാൽ CGRF ൽ പരാതി നൽകുകയും CGRF നടപടികൾ പൂർത്തിയാക്കി 21/02/2025 ൽ ഉത്തരവിറക്കുകയും ചെയ്തു. CGRF ന്റെ ഉത്തരവിന്റെ അപ്പീലായിട്ടാണ് ഈ പരാതി ഓംബുഡ്സ്മാൻ സമക്ഷം സമർപ്പിച്ചിട്ടുള്ളത്.

The appellant Shri. Iqbal. M is the Director of M/s. Malabar Realtors Pvt.Ltd. and this firm is an HT consumer (LCN : 12/3875) of Licensee KSEBL under their Electrical Section, Central. The agreement authority is the Dy. Chief Engineer, Kozhikode and billing is done by SOR, KSEBL. The tariff applicable to this connection is HT IV B commercial with contract demand 200 KVA. This connection was effected on 12/08/2002. The energy meter (ToD meter ) was defective during 08/2022 and the consumer informed the Licensee. The meter was tested and declared faulty by letter dated 19/09/2022. The consumer has been asked to replace the meter and CT/PT unit. The appellant has purchased the meter and accessories and tested the same at the TMR lab Kannur. The testing was completed on 31/10/2022 and meter was handed over to the Section. The clearance of HT panel with the wall was not sufficient and hence the shifting of panel was necessitated. On completing the shifting the meter has been installed and commissioned only on 22/10/2022. The replacement of meter was delayed beyond two months and hence the Licensee had applied meter fault penality for Rs. 6,49,840/-. The consumer requested for the waiver of the penalty as he had procured the meter & accessories well within the time.The claim of the consumer has not been agreed by the Licensee and then he filed the petition to CGRF. CGRF issued order dated 24/01/2025. This petition is filed as an appeal to the CGRF order.
