The consumer, who is running a provisional store as a tenant and the applicable tariff to shop is commercial tariff only. By mistake, the KSEB had changed the tariff to industrial which is a lower tariff. To compensate the undercharging during the disputed period, the KSEB issued the short assessment bill and another penal bill raised subsequently on detection of unauthorized additional load in the premises of the consumer. The Forum upheld the decision of the CGRF and allowed instalments to the consumer.

The consumer had applied for additional load and paid OYEC amount for installing a transformer and associated works. While inspecting premises for giving additional load, it was detected unauthorized additional load in the premises of the consumer and penal bill issued charging for the previous 12 months. The CGRF refused to entertain the petition for want of jurisdiction and accordingly the complaint was dismissed. The case was heard and since found merits, it was remanded to the Assistant Engineer for hearing and disposal as per law.

The cause of the dispute is the change of tariff from domestic to commercial category, in the case of the ‘Common Electric service connection’, used for the operation of Lifts, water pumps, Corridor Lighting etc. in the multi storied building, M/s Sheethal Apartments and the issue of subsequent monthly bills accordingly at the higher tariff. The tariff was changed without issuing any notice or hearing their views. The case disposed in favour of the appellant.
