The appellant, Smt. Radhika Rani, a consumer under Electrical Section, Pandalam with consumer number 2468, had applied to the Assistant Engineer on 20-12-2017, for changing the ownership of the service connection registered in favour of her father, Sri. N.K. Madhavan, to her name. But, due to the objections filed by Sri Madhavan, the service connection was not transferred in the appellant’s name. The appellant approached the respondent seeking for transfer of ownership of the service connection in her name since she submitted all the requisite documents for changing ownership. According to the respondent, the changing of ownership is not registered due to the dispute. There upon the appellant filed a complaint before the CGRF, Kottarakkara, which was dismissed with a dissenting note of one member of the Forum, vide order OP No. 30/2018 dated 17-05-2018. Aggrieved by the order of the CGRF, the appellant has submitted this appeal petition before this Authority. In view of the discussions, it is concluded that the respondent is directed to change the ownership of the electric connection number 2468 to the appellant on deposit of security amount afresh by the appellant as per Regulation 91(4) (f) and also consider the request for changing consumer category of the tariff observing all other formalities. This shall be done at any rate within 30 days from the date of receipt of this order. It is also made clear that the security deposit remitted by Sri Madhavan can be refunded to him on his application if any as per the prevailing rules. The order of CGRF, Kottarakkara in OP No. 30/2018 dated 17-05-2018 is set aside. No order as to costs.

The appellant has filed the appeal petition, being aggrieved at the inaction of KSEBL to shift the transformer erected in front of his property situated under Electrical Section, Thevalakkara. The appellant alleges that the said transformer was installed without informing him. Due to the installation of transformer, he finds difficulty to enter the property. Though the appellant had approached the officers of KSEBL and District Collector for shifting the transformer, his grievance is not yet settled. The appellant has filed petition before the CGRF, Kottarakkara vide Petition No. OP No. 31/2018 and the CGRF has dismissed it by order dated 14-05-2018, as a case on same subject matter is pending before the District Collector. Still aggrieved by the said order, the appellant has filed the Appeal Petition, before this Authority. In view of the factual position I don’t find any reason to interfere with the findings and decision taken by the CGRF, Kottarakkara in this case and hence the order of CGRF is upheld. The appeal is found devoid of any merits and hence dismissed. Having concluded and decided as above, it is ordered accordingly. No order on costs.

The appellant, Smt. K.S. Seena is a three phase commercial consumer with consumer number 1155834026726 under LT VII A tariff of Electrical Section, Perumbavoor. The appellant is paying the current charges regularly without any dues or delay. But the respondent as per the letter dated 17-02-2017 directed the appellant to remit an amount of Rs. 13,400/- being the short assessment of fixed charge for the period from 01/2012 to 09/2016 based on the findings in the Regional Audit Report. Against the short assessment bill, the appellant had approached the CGRF, Ernakulam by filing a petition in No. 128/2017-18. The Forum dismissed the petition vide order dated 31-05-2018. Aggrieved against this, the appellant has submitted the appeal petition before this Authority. From the findings and conclusions arrived at as detailed above, I decide to set aside the short assessment bill amounting to Rs. 13,400/- issued to the appellant. The respondent is directed to revise the bill by limiting the period for 24 months for the fixed charge of the present connected load after conducting an inspection in the premises of the appellant. The appellant is also eligible for installments, if requested for, and the respondent shall issue the same. The consumer shall pay the whole amount or the 1st installment within 30 days of the revised bill date. The subsequent installments will bear interest from 30th day of the bill issued to the day of payment. No interest or surcharge is payable by the consumer for the Petition and Appeal pending period before the CGRF and this Authority up to 30th day of the revised bill date. Having concluded and decided as above it is ordered accordingly. The Appeal Petition filed by the Consumer is allowed as ordered and stands disposed of as such. The order of CGRF in OP No. 128/2017-18 dated 31-05-2018 is set aside. No order on costs.
