The appellant remitted Rs.1,41,894/- towards “other charges” specified in the regular monthly bills from 01-11-2018 to 02-11-2020. As per respondent “other charges” mentioned in bills are low power factor penalty. Since no action was taken by the Officers of KSEB Ltd., the appellant filed petition in CGRF, Northern Region, and the Forum in its order dated 02-03-2021 rejected the request of the appellant. The appellant filed this appeal petition before this Authority. There are lapses on the part of appellant in maintaining the rated values of capacitors to avoid power factor disincentives and lapses on the part of respondent to intimate the subject of low power factor to the appellant as per rules. As such, it is decided to refund the power factor penalty realized from the appellant for 12 months from 11/2019 to 11/2020, by limiting the period of refund requested by the appellant. The respondent shall refund the amount realized under “other charges” or “power factor penalty” from the appellant from 11/2019 to 11/2020 within 45 days from the date of order or adjust in the future bills. The Appeal Petition filed by the appellant is allowed to this extent and the petition stands disposed of accordingly. The order of Consumer Grievance Redressal Forum, Northern Region, Kozhikode vide No.126/2020-21 dated 02-03-2021 is set aside.

The major problem of the appellant is frequent interruption of power supply and thereby major damages occurred to the lifts, escalators, kitchen equipments, sound system of theatres, cameras etc. The interruptions are for one minute to five minutes continuously. Sometimes supply will come from different feeders and motors are running in reverse direction. Every month the diesel consumption for generators is 450 litres and for the month of March 2021, consumption of diesel was 1200 litres. The request of the appellant is to solve the above mentioned problems. The premises of the appellant having a number of services connections and which are being fed from ‘Niranam 11 kV feeder’ from Substation, Kadapra. It is a fact that the said feeder is passing through thick vegetation and therefore be chances of interruptions, especially during summer rains and during monsoon are comparatively higher. The appellant filed a petition in CGRF, Southern Region, and the Forum in its order dated 06-03-2021, issued the following direction to the respondent: - “The respondent is directed to complete the construction work of the new HT ABC 11kV feeder and commission the same within 2 months from the date of receipt of orders”. The appellant filed the appeal petition before this Authority. Later, the appellant is satisfied with the action of the respondent in avoiding frequent interruption of power supply by energising the 11 kV line constructed, using Aerial Bunched Cable (ABC) from ‘Kadapra Substation’ to ‘Pannai’ and for the speedy work, CGRF, Southern Region had issued direction in OP No. 103/2020 dated 06-03-2021. The respondent is directed to initiate suitable actions to avoid reversal of rotation of electric motors in the premises of the appellant while back-feeding the said area from other 11 kV feeders at an early date.

The appellant installed an ‘On-Grid Solar Plant’ and connected to the Grid of KSEB Ltd. on 09-03-2018. The appellant received an electricity bill for Rs.84,028/- on 13-11-2020, which was brought to the notice of officials of Licensee and further filed petition before CGRF, Northern Region with a request to exempt from remitting the bill amount. The Forum limited the period of assessment of the bill for 12 months from 20 months. The appellant filed this appeal petition before this Authority. This Authority decided to accept the observations made by the CGRF, Northern Region and hence, upheld the decision taken by the Forum in OP No. 93/2020-21. The appellant is exempted from remitting interest or surcharge for the disputed amount or the revised amount as per the order of CGRF in the petition pending period before CGRF, Northern Region and the appeal petition pending period before this Authority.
