The appellant was given a bill for Rs.22,93,364/- towards the outstanding arrears as on 30-11-2020. The appellant remitted Rs.5,00,000/- for avoiding disconnection of electric supply to the premises and filed a petition in CGRF, seeking relaxation and concession in the bill amount. But the Forum in its order, dismissed the petition. The appellant filed this appeal petition before this Authority. As ordered by KSEB Ltd., the rebate @25% on fixed charge for the month of months of March, April and May 2020 amounting to Rs.55,770/- had already been allowed to the appellant on 03-07-2020. Since the rebate on fixed charge granted by KSEB Ltd. had already been given to the appellant and there is no orders or direction from KSEB Ltd. or from other empowered bodies to extend any benefit, the request of the appellant to set aside the bill amount, waiving of fixed charge from March 2020 to December 2020 and the request for exempting the energy charge for the said period stands rejected. The Appeal Petition filed by the appellant stands dismissed as it is found having no merits. The order of CGRF, Northern Region, Kozhikode in OP No.121/2020-21 dated 07-04-2021 is upheld.

The appellant was given a demand note for Rs.15,93,939/- towards a total outstanding amount as on 30-11-2020 by the respondent and the appellant requested the respondent to exempt from remitting fixed charge. The appellant filed a petition in CGRF, and the Forum issued order dismissing the petition. The appellant filed this appeal petition before this Authority. Since the rebate on fixed charge granted by KSEB Ltd. had already been given to the appellant and there is no orders or direction from KSEB Ltd. or from other empowered bodies to extend any benefit, the request of the appellant waiving of fixed charge from March 2020 to October 2020 and the request for exempting the energy charge for the said period stands rejected. The Appeal Petition filed by the appellant stands dismissed as it is found having no merits. The order of CGRF, Northern Region, Kozhikode in OP No.120/2020-21 dated 26-03-2021 is upheld.

Following the judgement of Hon’ble Supreme Court dated 20-02-2020 in Civil Appeal No: 8350/2009 filed by KSEB Ltd. against the judgement of Hon’ble High Court of Kerala in the subject of determination of tariff of Self-Financing Institution, the appellant was given a short assessment bill for Rs.3,64,951/- on 08-01-2021 towards the difference in tariff rate between LT VIA tariff and LT VIIA tariff for the period from 12/2007 to 06/2020 including surcharge. The appellant approached the respondent for a revision of the amount and later filed a petition before CGRF and the Forum in its order dated 31-05-2021 had taken decision in favour of the Licensee. The appellant filed this appeal petition before this Authority. In a period of certain petitions and appeal petitions filed by similar institutions were being considered by the Hon’ble Courts, the Licensee cannot issue such bills on the same subject to the appellant. Only on 05-01-2020, KSEB Ltd. decided to issue bills under higher tariff rate to the Self-Financing Educational Institutions except those who availed favourable orders from Hon’ble High Court of Kerala. On the above circumstances, the appellant is liable to remit the amount. The appeal petition No. P-043/2021 filed by the appellant stands dismissed. The order dated 31-05-2021 in OP No:11/2021 of CGRF, Southern Region is upheld.
